1. About SILKSTAND

SILKSTAND is a curation and resale platform for preloved luxury fashion, with operations based in Mexico. We source directly in Asian markets (Japan, China and Korea), selling direct-to-consumer through silkstand.com and international distribution channels.

SILKSTAND acts as a direct seller. Every item published is a unique piece (1-of-1) that has gone through our internal process of curation, documentation and verification before being offered to the public.

2. Eligibility

Use of this site and the placing of orders is available to persons over 18 years of age with the legal capacity to enter into contracts. By using the site, you represent that you meet these requirements.

3. Products: Preloved Nature

All items sold on SILKSTAND are second-hand, collectible or archive pieces. By completing a purchase, the customer acknowledges and accepts:

• That items are preloved and may show signs of wear consistent with their history
• That the condition of each piece is documented on its product detail page and corresponding Preloved Score®
• That product photographs and information have been produced with the highest possible level of detail
• That brand and designer names mentioned on product detail pages are used exclusively for descriptive and identification purposes, and do not imply sponsorship, association or endorsement by the trademark owners

4. Authenticity and Intellectual Property Protection

4.1 Verification Process

SILKSTAND applies an internal verification process to every item before publication, including physical inspection, detailed photographic documentation (including 360° video), and review of materials, finishes, hardware and labels in accordance with the known standards of each brand.

This process is carried out by our curation team based on specialized knowledge of the secondary luxury market and up-to-date reference sources.

4.2 Scope and Limitations of Verification

SILKSTAND is not an agent or authorized representative of any luxury brand. Our verification process represents the reasonable best effort of a curator specialized in the secondary luxury market, and does not constitute an absolute guarantee of authenticity certified by the trademark owners.

The global second-hand fashion market operates at large volume and scale. SILKSTAND acknowledges that, despite our constant and rigorous efforts, identifying counterfeits is a challenge inherent to the sector that no secondary-market platform, including global leaders, can guarantee with absolute certainty in every case.

SILKSTAND works proactively and continuously to:

• Identify and remove from the catalog any item that could infringe intellectual property rights
• Refine and update verification criteria as the market evolves
• Collaborate with brand representatives and rights holders when we receive notices of alleged infringement
• Take immediate action upon any documented and substantiated claim from a rights holder

4.3 Intellectual Property Infringement Notice

If you are an intellectual property rights holder, or act on behalf of one, and believe that an item published on SILKSTAND infringes those rights, we invite you to notify us immediately:

• Email: admin@silkstand.com
• Subject: IP CLAIM + [brand name / item / product number]
• Include: identification of the rights holder, description of the alleged infringement and evidence of ownership

SILKSTAND will respond within a reasonable period and take appropriate measures, including temporarily removing the item during the investigation.

4.4 Use of Trademarks for Descriptive Purposes

Third-party names, registered trademarks and logos mentioned in SILKSTAND product descriptions are the property of their respective owners. Their use on this site is made exclusively to identify the origin and characteristics of the second-hand item, in accordance with the descriptive use permitted under the nominative fair use doctrine and applicable intellectual property laws.

4.5 Buyer Authenticity Claims

Any authenticity claim must be submitted within 7 calendar days of the order's confirmed delivery, following the process described in this section. Reports from verification services unilaterally engaged by the customer are not binding on SILKSTAND.

The exclusive process for submitting an authenticity claim is as follows:

 
1. Timely notice: email admin@silkstand.com with the subject line AUTHENTICITY + [Order Number] within 7 calendar days of confirmed delivery, describing the specific elements that raise doubt.
 
2. Preservation of the piece: the item must be kept in the condition in which it was received, unused and unaltered, with all tags, certificates, and materials provided by SILKSTAND.
 
3. Physical inspection: the piece must be returned via insured, tracked shipping for physical inspection and comparison against the documentation generated before the sale (high-resolution photographs, 360° video, and internal curation records).
 
4. Independent verification: if the dispute persists after inspection, the parties may jointly designate, in writing, an independent authenticator to physically examine the piece. No report issued without physical inspection of the piece, or by a provider selected unilaterally by either party, shall be binding.
 
5. Resolution: if the claim is substantiated, SILKSTAND will refund the price paid, shipping costs, and the reasonable cost of the agreed independent verification.

Chain of custody. Once the piece has been delivered and the claim window has lapsed, SILKSTAND is unable to verify that the item presented is the piece that was sold, or that it has not been used, altered, or substituted. For this reason, claims submitted after the window, or concerning pieces that cannot be returned for physical inspection, will not be processed.

Third-party reports. Reports from online, remote, or photo-based authentication services, as well as any report obtained without physical inspection of the piece or issued by a unilaterally engaged provider, are not binding on SILKSTAND, do not on their own establish lack of authenticity, and do not create any refund obligation.

Fraudulent claims. SILKSTAND exhaustively documents every piece before shipment (photographs, 360° video, and internal records). In response to claims supported by falsified or manipulated reports, or the presentation of a piece other than the one sold, SILKSTAND reserves the right to pursue all applicable civil and criminal action.

Nothing in this section limits the rights granted to consumers under applicable law.

5. Prices and Payment

All prices published on silkstand.com include the item and the cost of specialized packaging. Shipping costs and, where applicable, import taxes are detailed during checkout before confirming the purchase.

SILKSTAND reserves the right to modify prices without prior notice. The applicable price is the one in effect at the time payment is confirmed.

6. Availability

All items are subject to availability. As these are 1-of-1 pieces, availability cannot be guaranteed until payment is confirmed. Should an item no longer be available after payment confirmation, SILKSTAND will issue a full refund within the following 3 business days.

7. Site Intellectual Property

All original content on silkstand.com — including photographs, 360° videos, texts, product detail pages, Preloved Score®, logos and site design — is the exclusive property of SILKSTAND and is protected by applicable intellectual property laws. Reproduction in whole or in part without written authorization is prohibited.

8. Limitation of Liability

To the maximum extent permitted by law, SILKSTAND will not be liable for indirect, incidental, special or consequential damages arising from the use of the site or the products purchased. SILKSTAND's total liability for any claim will not exceed the value of the item subject to the transaction.

9. Indemnification

By using this site, you agree to defend, indemnify and hold harmless SILKSTAND, its officers, employees and collaborators against any claim, damage, loss or expense — including reasonable legal fees — arising from your use of the site, your breach of these Terms, or any third-party claim related to content you have provided.

10. Force Majeure

SILKSTAND will not be liable for delays or failures arising from causes beyond its reasonable control, including natural disasters, armed conflicts, pandemics, strikes, government restrictions, carrier service interruptions or customs blockages.

11. Modifications

SILKSTAND may update these Terms at any time. Changes take effect from the moment they are published on the site. Continued use of the site after changes are published constitutes acceptance of them.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that might correspond to them by reason of their present or future domicile.
